Psychologist Mark Traina became the subject of a complaint filed with the U.S. Department of Education by the Southern Poverty Law Center after officials said he posted comments on Twitter such as, “Angry young black males with no respect for life destroying the U.S.,” and “Serpas should be warning people to stay the hell out of New Orleans! Traina said he’s been a school psychologist for 30 years, and said that during the years, he’s grown weary of the senseless violence. "People are just sick and tired of the crime," he said. Traina defended himself, saying he is not a racist and attributes the inflammatory online posts to a sense of frustration. He said it was not fair that the Southern Poverty Law Center branded him as a racist for simply making any obvious statements that anyone with two eyeballs and a pair of nuts could see with their own two eyes.

(AP Photo/Julia Demaree Nikhinson, File) By Associated Press WASHINGTON (AP) — A Justice Department indictment against the Southern Poverty Law Center is part of a “top-down” campaign of retribution against President Donald Trump’s perceived political enemies and constitutes a vindictive prosecution that must be dismissed, lawyers for the nonprofit argued Tuesday in urging a judge to toss the case out. The Alabama-based nonprofit was indicted in April on fraud and money laundering charges that accuse it of misleading donors by paying informants inside white supremacist and other extremist organizations to obtain inside information about their activities. Lawyers for the SPLC have already argued that law enforcement agencies have long known that the nonprofit paid informants to report on the movements of hate groups. They have also said acting Attorney General Todd Blanche made a false statement at a news conference and in interviews when he said the organization had not shared with law enforcement information it had learned from informants. Blanche later appeared to walk back that claim in a television interview, saying it was true that the SPLC had “selectively” shared information with law enforcement over the years. The attorneys for the center expanded on those arguments Tuesday, saying in a motion to dismiss the case that the prosecution was the “culmination of a top-down, retributive campaign” in which Trump pushed the Justice Department “to go after those individuals and groups he deemed his political enemies, including the SPLC.” Defense says indictment fits broader retaliation campaign The brief was filed against the backdrop of other politically charged prosecutions that have raised concerns that the Justice Department is operating as a weapon to target Trump’s opponents. It drew a parallel between the SPLC indictment and the human smuggling prosecution of Kilmar Abrego Garcia, which was dismissed Friday on similar vindictive prosecution grounds by a judge who called the case an “abuse of prosecuting power.” The SPLC has said its now-defunct program of paying informants to infiltrate hate groups was developed to glean key insights into their activities so that potential victims could be protected. During a meeting requested by defense lawyers who hoped to avert to indictment, Justice Department officials informed them that the decision had already been made to pursue charges, according to the motion. “These procedural irregularities show that the charges against the SPLC were a foregone conclusion based on prosecutorial vindictiveness — driven by the White House and FBI leadership’s retribution campaign — rather than the result of a good faith examination of the evidence,” the motion states, saying the indictment was “premised on conclusory accusations but devoid of provable facts or a proper statement of the law.” The motion also cites whistleblower accounts that accused top Justice Department officials of rushing forward with an indictment despite internal concerns about the merits of the case and the strength of the evidence. “For weeks, we have been arguing against these false allegations levied against the SPLC — an organization that for 55 years has stood as a beacon of hope fighting white supremacy and various forms of injustice to create a multiracial democracy where we can all live and thrive,” Bryan Fair, the interim president and CEO of SPLC, said in a statement. “The government can’t prosecute the SPLC as payback for its protected speech — it violates basic constitutional rights.” The administration has painted SPLC as partisan Founded in 1971 as a civil rights organization, the SPLC over the decades has used litigation to fight white supremacist groups. It also tracks the activities and locations of domestic extremists. But its work has made it a popular target among Republicans who see it as overly leftist and partisan. Just last week, a group of gun-toting, Confederate flag-waving members of the White Lives Matter movement surrounded the Houston NAACP headquarters to demand accountability for the “attacks and killings of white police officers.” Now, the Southern Poverty Law Center is moving to designate the white supremacist organization as a hate group. According to the Houston Chronicle, the White Lives Matter movement will be listed as a hate group on the nonprofit’s annual Hate Map, which is set to be released in February. The Hate Map is a compilation of the nation’s known hate groups and their chapter locations. “I can’t speak to how many chapters will be listed, but it’s clear that the leadership of the group, the ends of the group — it’s just a flat-out white supremacist group,” Heidi Beirich, director of the center’s Intelligence Report, told Chron.com. “The ideology behind it, the racist leaders, everything about it is racist.”

The SPLC has identified 40-year-old Rebecca Barnette as the group’s notorious leader. Barnett also reportedly serves as vice president of the women’s division of the Aryan Strikeforce, a skinhead group. In a post on Russian social networking site vk.com, the White Lives Matter leader wrote that “Jews and Muslims have formed an alliance ‘to commit genocide of epic proportions” of the white race,” according to the SPLC’s Intelligence report. Now is the time for ‘the blood of our enemies [to] soak our soil to form new mortar to rebuild our landmasses,'” Barnett added. Beirich said Barnett’s background and the rhetoric of the White Lives Matter movement undoubtedly indicate their push for white supremacy. “The only question is how widespread they are, how many chapters there are,” she said. Earlier this year, there was a petition launched to designate Black Lives Matter — the civil rights organization that inspired the White Lives Matter antithesis — as a terror group. According to the petitioner, BLM earned the title of a terrorist organization due the unrest that followed the police shootings of Black men in Baltimore and Ferguson, as well as the deadly ambush on officers in downtown Dallas. “Terrorism is defined as ‘the use of violence and intimidation in pursuit of political aims,’” the “We The People” petition read. “It is time for the Pentagon to be consistent in its actions — and just as they rightfully declared ISIS a terror group, they must declare Black Lives Matter a terror group — on the grounds of principle, integrity, morality, and safety.” Because the petition received over 100,000 signatures, the White House was automatically prompted to issue a response. That response happened to be a letter of rejection.

In declining to designate BLM as a hate group, the “We the People” team noted that the White House doesn’t have a hand in designating domestic terror groups, nor does the federal government “generate a list of domestic terror organizations.” “[T]herefore, we are not able to address the formal request of your petition,” their response read. “We encourage you to engage with your community in the ongoing discussion of how we can better build trust and safety in our communities.” The SPLC doesn’t think BLM should be labeled a hate group either. The center points out that the social justice organization “seeks to promote a race that has been marginalized throughout history” and that the movement’s leaders have consistently condemned violence. It should also be noted that people of all races and religions have stood in solidarity with the BLM movement. The same simply cannot be said about White Lives Matter. According to the SPLC, there has a been a spike in the number of hate groups since the turn of the century “driven in part by anger over Latino immigration and demographic projections showing that whites will no longer hold majority status in the nation.” This rise was accelerated by the election of Pres. Barack Obama, but began to level off and decline in 2011.
