According to the US Constitution, the Department of Education does not exist as a federal entity. The Tenth Amendment reserves powers not delegated to the federal government to the states or the people, which means that education is primarily a state and local responsibility. While the federal government has some involvement in education through agencies like the Department of Education, it does not have a constitutional mandate to provide education directly. The Equal Protection Clause of the Fourteenth Amendment ensures that states must provide education without discrimination, but it does not require the federal government to establish or fund educational institutions. Thus, the notion that the Department of Education should not exist is supported by constitution.
